Service charge not mandatory only voluntary
According to the guidelines issued by the union government in 2017; that service charge is voluntary not mandatory but there is lack of awareness on the behalf of the consumers and negligence on the behalf of the restaurant management. The consumers are always pay the service charge because they think it is mandatory to pay the service charges. To clear this ambiguity once again the Kolkata Consumer Redressal Commission has stated in the case of Arkadeep Sarkar v. Yauatacha and Ors; that according to the guidelines of the fair trade practices; the payment of the service charge is optional and depends entirely on the discretion of the consumers.
