Delhi court summons AAP leaders in defamation case

On Wednesday, Delhi court summoned; Satyendar Jain, Atishi, Raghav Chadha, Sourabh Bharadwaj and Durgesh Pathak, Aam Aadmi Party (AAP) leaders in a defamation case.

Chhail Bihari Goswami, Bharatiya Janta Party leader and chairperson of the; Standing Committee of North Delhi Municipal Corporation  filed the complaint against the Aam Aadmi Party (AAP) leaders.

As per the complaint; the government of NCT  presumed that the revenue collected from different sources between; the government of NCT and all three Municipal Corporations as per the constitutional mandate and; existing law, but the Aam Aadmi Party, with the dishonest intention of gaining political mileage in the upcoming; Municipal Corporation Elections, is not releasing the consolidated due funds of Rupees. 13,000 crores to the three Municipal Corporations.

It is also claimed that; the accused are misleading the general public and establishing a terrible image of BJP councilors, including the complainant, with the common goal of winning the next Municipal Elections.

To deflect the attention from the situation and to cover up the non-payment of funds, the accused devised a criminal conspiracy and have been making false claims against the three corporations governed by the BJP, as well as leaders and councilors of BJP.

The complaint also stated that, as part of the criminal conspiracy, Durgesh Pathak held a press conference in which he made false allegations that were defamatory in character, stating that the BJP councilors in the North MCD had cheated the public out of Rupees. 1400 Cr. and split the money equally among them.

Satyender Jain made a parallel defamatory allegation in a press conference on December 12, 2020, which also uploaded on the Aam Aadmi Party’s Facebook page.

 on December 12, 2020, Aatishi Marlena conducted a news conference, which  also live streamed on the Aam Aadmi Party’s Facebook page, where she made false claims against BJP leaders involving a Rupees 2500 Cr. scandal.

It is alleged that; the accused parties have a dishonest intent to degrade the complainant’s moral and intellectual character in the eyes of the general public.

After hearing the arguments, Ravindra Kumar Pandey , Additional Chief Metropolitan Magistrate is of the opinion that; the accused persons, Satyender Jain, Aatishi Marlena, Raghav Chadha, Durgesh Pathak, and Sourabh Bhardwaj, have committed; the offence punishable under Sections 499/500 of IPC read with Section 34 of IPC. As a result, these defendants will be summons to appear on March 14, 2022.
