CCTV Cameras in Classroom Ensure Safety of Children, Right To Privacy Not Violated: Delhi High Court
Case Title: Delhi Parents Association & Anr. V. Govt (NCT of Delhi)
The case mentioned above states that the CCTV camera installed in the Government schools violate the right to privacy.
The Delhi Government has stated to the Delhi High Court that the installation of the CCTV cameras is not for intruding the privacy of the children but mainly for the purpose of ensuring their safety and security, especially in the view of the rampant incidents of sexual abuses and child bullying.
The submission of the short affidavit was done by the Delhi Government in response of the plea moved by the Delhi Parents Association (DPA) And the Government School Teacher Association, challenging the decision of installation of CCTV in the classroom in all Government School or the schools run by the private entities. The Plea was filed through Adv JAI ANANT DEHARIA impugns the two decisions dated 11th Sept and 11th Dec of 2017 passed by the Delhi Government. These circulars make the provision of installation of CCTV cameras in the classroom run by the states with the live streaming of the video directly to the parents.
The Government stated that, the decision of the installation of the CCTV was necessary due to the increasing incidents of violence in the schools and the inability of their management to ensure the protection the children, compelled the government throughout the country to rethink about the safety and security in school and establish new rules and regulation for the safety and security of the children.
The Government states that, the idea of the installation of the CCTV cameras was in the pipeline for a long period and was not just a knee jerk reaction of the child abuse reports of September 2017.
One of the other goals of this project is also to improve the teaching-learning processes and providing feedback the teachers so that they can improve or can make changes in the idea of their teaching.
On the other hand, Delhi Parents Association (DPA) And the Government School Teacher Association stated that the decision of installation of the CCTV was an impugned decision and was made without obtaining any specific consent from the student, the teachers, or the parents which is the gross violation of their Right to Privacy.
The parents are against the concept of cross sharing of the live footage to other parents or the third person as they believe that this footage or video can be misused for morphing and dissemination on social media.
