Uniform Civil Code Is Public Policy Matter, No Directions Can Be Issued To Parliament’: Center To Delhi High Court

 Uniform Civil Code is a directive principle under the Constitution for which Delhi High Court has been informed by the Central Government that; implementation of that is a matter of public policy and that court can’t issue any directions in this matter.

In the counter affidavit which has been filed by the Center in the PIL filed by BJP leader Ashwini Upadhyay, seeking introduction of Uniform Civil Code in the country, a submission has come.

“The Govt submits that, The Parliament have sovereign power to enact laws. No other outside power or authority can issue a direction to enact a particular piece of legislation” .

Center submits that the Delhi High Court in Mool Chand Kucheria v. Union of India held it would be suitable to think all laws have to be made applicable to all people. The Center Govt also submits that; petitioner cannot direct executive to bring in a particular piece of legislation.
