Thane court denies anticipatory bail to man accused of concealing homosexuality from wife

The lady mentioned in her police complaint that; she found his homosexuality after seeing his WhatsApp chats and other stuff on his phone.

On Tuesday, a Thane court refused anticipatory bail to a 32-year-old Navi Mumbai man accused of deceiving his wife by concealing his homosexuality from her [Rohan Pradeep Shinde vs The State of Maharashtra].

Additional Meetings Judge RS Gupta stated that the defendant defrauded his wife and ruined her future.

“Without a doubt, everyone has the right to live in a society. No one else can interfere with a person’s lifestyle, but that; does not give a person the right to damage either spouse’s life “According to the Court.

After meeting on a social networking platform, the accused and complainant married in November 2021.

The lady added in her police complaint that; she found his homosexuality after reading his WhatsApp chats and other stuff on his phone, which revealed that he had sexual encounters with two men from Mumbai.

According to the complainant’s counsel, Sagar Kadam, the accused showed the complainant and her parents a falsified job offer letter indicating that; he would be paid 19 lakh per year in order to impress them before their wedding.

Prosecutor VA Kulkarni and Kadam stated that; the accused disguised his homosexuality before to the marriage, deceiving the plaintiff and damaging her life. It  claimed that;  the applicant  just interested in financial aid from the complainant’s parents and caused them unlawful loss in the millions of rupees.

The officer in charge of the inquiry noted that; he uncovered the accused’s conversations with other male associates, which clearly indicated that; he  interested in gay relationships..

The defence counsel, advocate Valinjkar, disputed the prosecution’s version, arguing that; it designed to malign and harass him, and requesting relief.

After hearing both parties, the court stated at the opening,

“It should be noted that;  Hindu Marriage is a religious institution in which a man and a woman are bound in permanent partnership for the physical, social, and spiritual purposes of Dharma, reproduction, and sexual pleasure.”

While rejecting the accused’s anticipatory bail plea, the Court stated,

“It is worth noting that the material repression has harmed not only a young girl’s financial situation, but also her whole life. If this  openly communicated before to the marriage, the outcome would have been different.”
