It’s the stark reality of a society that they are discriminating same-sex couple: Allahabad high court

The Bench of Justice M.C Tripathi and Justice. S. K Pachori hearing the plea filed by a same-sex couple. The plea was in a wish for getting protection as both are facing hard resistance from the side of parents and from the society. The Hon’ble court reiterates the principles envisages in the matter of Navtej Singh Johar v/s Union of India in which the court grants protection to homosexual people.

In the matter before the court, the homosexual couple was facing discrimination. They were facing the violation of their fundamental rights enriched under article 21 on the basis of their sexual orientation.

The court scrutinizing the matter hails that both the person are major by their age. They both are earning a handsome amount and they can lead their life on their own. The court didn’t allow the stark society to discriminate against them on basis of sexual preference. The court puts forward that it is a type of inhumane treatment. One person has the choice to choose his better half to live life with comfort and love.

The principles of Navtej Singh Johar’s case fit well in the matter. It allows the court to enhance the purview of the rights that article 21 mentions. The court interprets the article in reference to basic human rights in a very liberal connotation. The court grants protection to the aggrieved.
