Expulsion of Rohingyas violates Article 21 and international norms and it is also like sending them to death or torture: Petitioner to Supreme Court

A petition has been filed by Mohammed Salimullah to the supreme court for the release of Rohingyas and refrains the government from making an order for their deportation. The pleas also seek their protection.

Now in this petition, one of the petitioners filed an affidavit. In this affidavit, he states that; the deportation of these Rohingyas refugees violates their right to life under Article 21 of the Indian Constitution. The affidavit also states that it also violates international norms. The affidavit further states that it is like sending them back to torture and death.  Some additional documents have been produced by the petitioner on the basis of this affidavit.

On 23rd January 2021, the chief justice of India, SA Bobde, with the 15 judge’s bench made an order in this case. The CJI said that the Rohingyas faced a lot of atrocities. They faced genocide and ordered the government of Myanmar to stop their military forces from continuing with the oppression with them.

The petitioner further contends that; India is a signatory of the UN convention on prevention and punishment for the crime genocide. This convention makes genocide an international crime. So, India has the obligation to prevent genocide.
