IN BHARATIYA NAGARIK SURAKSHA SANHITA FIR defines (section- 173)

First Information Report (FIR) is a written document prepared by the police when they receive information about the commission of a cognizable offence. It is a report of information that reaches the police first in point of time and that is why it is called the First Information Report.

 It is generally a complaint lodged with the police by the victim of a cognizable offence or by someone on his/her behalf.

 Anyone can report the commission of a cognizable offence either orally or in writing

.Multiple FIR

Multiple fir is the situation in which in respect of the same offences several FIRs have been lodged

. Cross FIR 

When such fir is lodged in the same cases by the opposite party

.Anti Timed FIR

It is the fir after a long delay of occurrence of the event but cannot be anti timed

Zero FIR

Whenever a police officer in charge lodges an FIR but that police station does not have jurisdiction to investigate such an fir ultimately is transferred to the police station having jurisdiction

IN BHARATIYA NAGARIK SURAKSHA SANHITA FIR defines (section -173)  It states that –

 Every information relating to the commission of a cognizable offence, irrespective of the area where the offence is committed may be given orally or by electronic communication and if given to an officer in charge of a police station

  • orally, it shall be reduced to writing by him or under his direction, and be read over to the informant; and every such information, whether given in writing or reduced to writing as aforesaid, shall be signed by the person giving it
  • by electronic communication, it shall be taken on record by him on being signed within three days by the person giving it

Provided that if the information is given by the woman against whom an offence under section 64, section 66, section 67, section 68, section 70, section 73, section 74, section 75, section 76, section 77, section 78 or section 122 of the  Bharatiya  Nyaya Sanhita, 2023 is alleged to have been committed or attempted, then such information shall be recorded, by a woman police officer or any woman officer

 What is the Procedure of filling an FIR?

The procedure of filing an FIR is prescribed / under   in Section 173  of the BHARATIYA NAGARIK SURAKSHA SANHITA 2023

. When information about the commission of a cognizable offence is given orally, the police ( Station House of officer ) must write it down

. Once the information has been recorded by the police, it must be signed by the person giving the information.

You should sign the report only after verifying that the information recorded by the police is as per the details given by you.

 * People who cannot read or write must put their left thumb impression on the document after being satisfied that it is a correct record

. * Always ask for a copy of the FIR. It is your right to get it free of cost.

What can  you do If your FIR is not registered ?

 -You can meet  The Station house officer or the Superintendent of Police or other higher officers like Deputy Inspector General of Police and bring your complaint to their  notice

you can direct file a complaint of illaqa Magistrate

. you can also file a complaint to the state human rights commission

What should you mention in the FIR?

* Your name and address

* Date, time and location of the incident you are reporting

* The true facts of the incident as they occurred

 * Names and descriptions of the persons involved in the incident

  • FIR is an important legal document that should be written accurately and in a specific format
  • The information provided in the FIR will be used by the police to investigate the crime
  • FIR should be written in police station both oral and written
