Organ Transplantation: Bombay High Court directs the Maharashtra govt to decide if a minor girl can donate her liver to her father
The Bombay High Court on Monday ordered; the Maharashtra government to immediately decide on a petition filed by; a juvenile girl seeking permission to donate a portion of her liver to her father, who is critically ill. [Riya Sagar Biyani v. Maharashtra State & Others]
Her father, who had ‘Liver Cirrhosis Decompensated,’ required a liver transplant, and the petitioner, a 16-year-old girl, had petitioned the High Court through her mother.
A minor may only transplant an organ or part of an organ with the consent of the Authorisation Committee established under the Transplantation of Human Organs and Tissues Act.
Riya Sagar Biyani, the petitioner, alleged that; competent authorities investigated all of the close relatives as possible donors, but that; none of them declared medically fit, with the exception of the daughter.
In addition, the family reported that; they had been unable to locate another appropriate donor.
As a result, the daughter filed an application; however, no response received.
The application should be considered as soon as feasible, according to a bench led by Justices Revati Mohite Dere and Madhav Jamdar, because; the minor’s father’s condition is severe.
As a result, the Bench ordered the committee to rule on the application by May 4, 2022.
