The Delhi High Court has dismissed a petition seeking information on the SC Collegium’s December 2018 meeting.
The Delhi High Court on Wednesday; dismissed a petition contesting a Central Documents Commission (CIC) order limiting access to information requested about; Supreme Court Collegium decisions made in a meeting on December 12, 2018.
Anjali Bhardwaj (activist) had filed an RTI application seeking information about the Supreme Court’s Collegium meeting on December 12, 2018, during which; the then-SC collegium, which included former Chief Justice of India Justice Gogoi and four senior-most Supreme Court judges, Mr. Justice Madan B. Lokur, A.K Sikri, S.A Bobde, and N.V Ramana, made decisions regarding the appointment of judges.
The Supreme Court’s Public Information Officer dismissed Bhardwaj’s request for information, citing sections 8(1)(b), (e), and (J) of the RTI Act.
Following that, Bhardwaj filed a complaint with the Act’s First Appellate Authority, which affirmed the PIO’s judgement but concluded that the CPIO’s reasons for denying the information were not legitimate.
The petitioner had requested “a copy of the agenda” of the collegium meeting, not a summary or reference, according to the plea.
As a result, the plea requested that; the impugned ruling issued by; the Central Information Commission; in Second Appeal be set aside as well as that the available information sought under the RTI application be disclosed.
