Disinclination expressed by The Rajasthan High Court; to entertain a public interest litigation looking for direction to remove all the defects;and glitches on the official portal of the Income Tax Department.
The administration left by the court to deal with the issues at its level.
A division bench of Chief Justice Akil Kureshi and Justice Rekha Borana said that,”At this stage, we leave it to the administration to deal with these issues at its level.
Various difficulties pointed out by the Tax Bar Association, Jodhpur faced by assesses on account of the official portal of the income tax department.
The court noted while declining to entertain the plea; that there has been across the board extension of last dates for compliances. The court observed that most probably, these extensions are approved because the Government of India had realized that;several assesses may not have been in a position to make the compliances on account of technical difficulties.
The court also observed that; there is nothing for it to imagine that the administration is not cognizable of such defects. It also observed that it is necessary to take proper steps for removing such defects ; so that the extension of last date for compliances does not remain illusory; but assesses can meaningfully take advantage of such extension.
