PIL petitioner falsely accused security agents of extrajudicial killings: Central government to Supreme Court.

 The Central government has petitioned the Supreme Court to find a public interest litigation (PIL) petitioner guilty of falsely accusing security personnel of extrajudicial executions during operations against left-wing militants in Chhattisgarh in 2009 [Himanshu Kumar vs State of Chattisgarh].

 CONTENTION OF THE PETIOTNER

 The case dates back to 2009, when the PIL petitioner, Himanshu Kumar, filed a petition with the Supreme Court detailing how security force personnel raped and looted tribal people in the areas of Gachanpalli, Gompad, and Belpocha in the district of Dantewada, Chattisgarh, between September and October 2009.

A Delhi District judge directed in 2010 by; the Supreme Court to record the petitioners’ statements. The recorded statements, on the other hand;  only made available to the Centre in March 2022.

WHAT CENTRE ALLEGED?

In its application to the Supreme Court, the government claims that after reviewing the remarks made public, it  obvious that;  the PIL petitioner’s allegations were “ex facie untrue, contrived, and deceptive.

Over time, it  customary for petitions to be filed by; persons and groups who are either advocates of left-wing extremism or profit financially from their contributions.

The petitioner’s main goal in this lawsuit was to divert the security forces from their ongoing efforts to netralize left-wing extremism.

It further requested that the Government Bureau of Investigation (CBI), the National Investigation Agency (NIA), or any other central agency investigate persons and organisations who have been aiding and abetting security forces from acting against naxal militia by filing court applications.
