While the Ministry of Youth and Affairs (MoY&A) took a positive step in December 2022 by including E-sports in the “multisports event” category, a formal legal declaration recognizing E-sports as a sport is still awaited. This leaves the industry in a state of flux, operating in a legal grey area.
Moreover, the existing legal framework presents potential challenges:
- The Public Gambling Act, 1867: This Act prohibits games of chance. While E-sports require skill, a degree of uncertainty associated with the outcome could raise concerns about its compatibility with the Gambling Act. However, courts have historically distinguished between games of skill and chance, and the emphasis on strategy and practice in E-sports strengthens the argument against its classification as gambling.
- The Prize Competition Act, 1955: This Act regulates lottery schemes and the awarding of prizes. E-sports tournaments often involve prize money, potentially bringing them under the purview of this Act. Nevertheless, the Act also exempts competitions based on a “substantial degree of skill.” This ambiguity necessitates a clearer legal framework specific to E-sports.
Uncertainties and Opportunities: Navigating the Regulatory Landscape
The absence of clear regulations creates uncertainties for E-sports stakeholders. These include:
- Taxation Labyrinth: The tax treatment of E-sports earnings and prize money remains unclear. Clear regulations would provide certainty for players and organizations regarding their tax obligations.
