In response to a petition submitted by Congressman Ajay Maken, the Punjab and Haryana High Court on Wednesday sent notice to Rajya Sabha Member Kartikeya Sharma. In the most recent Rajya Sabha elections, Maken disputed Sharma’s victory. After receiving support from the BJP and JJP, Sharma, an independent candidate, won the Rajya Sabha election. In contrast to Maken’s 29, he garnered 29.6 votes.
Maken claims that any votes cast in Sharma’s favour should have been disregarded since they were not placed in the appropriate column. Maken asserts that the outcome of the election would have been altered if the vote had been declared illegitimate. Furthermore, it has been asserted that Kartikeya Sharma won the election as a result of a vote that should have been deemed illegal but was instead accepted and cast by a member of the winning coalition.
In his challenge, Maken claimed that their agent continuously claimed that they had received 30 “single preference” votes, even though the actual number was 29. In the 90-member state assembly, Congress had 31 MLAs, which was enough to guarantee Maken a Rajya Sabha seat. While one MLA’s vote was invalidated, former Congress leader Kuldeep Bishnoi cast a cross-vote, which caused him to lose the Rajya Sabha election. Maken’s appeal was given notice by Justice H S Madaan of the Punjab & Haryana High Court, and it was set for return on September 19, 2022.
