Jammu & Kashmir court imposes ₹5k fine on man for making illegal modifications to his vehicle
A Jammu & Kashmir court on Wednesday imposed a fine of ₹5,000 on one Zahid Iqbal Wani for carrying out illegal modifications to his Mahindra Thar vehicle in contravention of Section 52 of Indian Motor Vehicle Act, 1988 (MV Act) [UT of Jammu and Kashmir V/s Zahid Iqbal Wani].
The verdict issued when the violation appeared in court and pleaded guilty to modifying/altering the vehicle in question from; its original condition, as specified in the vehicle’s registration certificate (RC).
“Because the violator violated a provision of the Motor Vehicle Act, a punishment of Rs. 5000 is imposed, and if the amount is not paid then; he sentenced to one-month imprisonment. The challan is so; disposed of and transferred to records once completed.
Shabir Ahmad Malik, Additional Special Mobile Magistrate (Traffic), Srinagar, also asked; RTO Kashmir to remove any modifications and restore the vehicle to its original state.
“The RTO Kashmir at; Srinagar is directed to remove all modifications; done in violation of the terms of the Motor Vehicle Act. Its guidelines, and return the vehicle to its original manufacturer’s Registration Certificate (RC).
The Court also ordered; the Deputy Inspector General of Traffic to take harsh action against individuals who illegally modified automobiles.
According to Section 52 of; the Motor Vehicle Act, “no motor vehicle modified or altered from its; original position in contravention of the provisions of the Motor Vehicle Act and without; the approval of the appropriate authority.”
