After a late-night hearing, the Punjab and Haryana High Court awarded Tajinder Bagga protection from arrest until May 10.
The Punjab and Haryana High Court on Saturday delayed; the arrest of Bharatiya Janata Party leader Tajinder Pal Singh Bagga in a case filed by; the Punjab Police until May 10, 2022, in a late-night hearing.
After hearing counsel at his Chandigarh home, Justice Anoop Chitkara issued the order.
Bagga petitioned the High Court for immediate relief after; Judicial Magistrate Ravtesh Inderjit Singh of SAS Nagar issued an arrest warrant for the BJP leader.
The Punjab Police have charged Bagga with violating the Indian Penal Code’s Sections 153A (promoting religious animosity), 505 (statements conducing to public mischief), and 506 (criminal intimidation).
Bagga has railed against Delhi Chief Minister Arvind Kejriwal on social media, especially Twitter, over his views on the film “The Kashmir Files.”
Following his words, a complaint was filed against him in Mohali.
On Friday, Punjab Police detained him in Delhi and were about to transport him to Punjab when Haryana and Delhi Police intervened and brought him back to Delhi.
Following that, Punjab Police got an arrest warrant for Bagga.
Bagga then went to the High Court with the help of attorneys Anil Mehta and Mayank Aggarwal.
Bagga argued in his petition that the prosecution is vexatious and based on political retribution.
He further claimed that his detention was unnecessary for the investigation because the material used in the case was electronic.
It also stated that; he is not a flight risk because of his profound societal roots.
At 10.50 p.m., Chief Justice Ravi Shanker Jha discussed the case. He subsequently brought the case to Justice Chitkara, who granted interim relief.
