Are there any perimeters to follow by people on the use of public transport during a pandemic? Bombay High Court to Centre

The Bombay High Court on Thursday asked the central government; if they have formulated any national plan under the Disaster Management Act to differentiate if the person is vaccinated before the use to public transport during the Covid 19. issue was put by the Bench of Justice Dipankar Datta and Justice MS Karnik; while hearing plea challenging the Maharashtra Government to not allow the unvaccinated person to travel any public transport.

The government of Maharashtra replied to the Senior Advocate Anil Anturkar; that they were not aware of any such plan by the center.
The Bench then asked the Centre to clarify its stand on whether it has prepared any plan to combat COVID-19 for implementation across the country.
The Bench previously enquires the petitioners that the courts have judicial power to review the matters regarding public health.
On behalf of the petitioner Advocate, Nilesh Ojah replied with the affidavit of the central government;which said they will not discriminate any individual based on their vaccination.

The High Court submitted that they can interfere with the decision that involves health-related policy.
Refuting this submission, Anturkar reiterated that the restriction to fundamental rights was reasonable during the pandemic as the same is a “precautionary measure”.
