The Supreme Court raps the Centre over the Tribunals Reforms Act, saying, “You are testing the patience of the court; you have no respect for our judgments.”

The Supreme Court chastised the Union Government on Monday for delaying the filling of vacancies in tribunals and for passing the Tribunals Reforms Act, which it described as a “virtual duplicate” of the provisions thrown down by the Court.

“This court’s verdicts are not respected.” You’re putting our patience to the test! How many people were chosen? You mentioned that some people have been appointed? “Where are the appointments?” asked the CJI right away.

“The Tribunals Act is almost a carbon copy of the clauses struck down by this Court in the Madras Bar Association case,” Justice Chandrachud continued.

By not nominating members to these Tribunals, you are weakening them. Many tribunals are on the verge of shutting down,” warned Justice Rao.

The issue has “seriously offended” the Court, according to the CJI.

“The NCLT and NCLAT are vital to the economy of the country. NCLT and NCLAT will not be able to meet the deadline due to vacancies. A grave situation has arisen due to the lack of staffing at NCLT and NCLAT. The AFTs are in a similar situation “remarked Justice Chandrachud.

The Solicitor General requested a response period of 2-3 days. He read the instructions from the Ministry of Finance, which said that the final decision on the Search-cum-Selection Committees’ recommendations will be made within two weeks.

The bench adjourned the case until Monday, stating that “we expect appointments to be completed by then.”
