Compensation to Covid-19 Victims: Plea in Allahabad High Court

Dr Sandeep Pandey “a Social Worker”, files a plea before the Lucknow bench of Allahabad High Court for the compensation to the Covid-19 victims. The Pleas seeks the directions to the State and Central Government for the formulation of Scheme; for the payment of Ex gratia compensation to the Covid-19 Victims, under the Disaster Management Act 2005.

The petitioner also seeks the refund of cost of hospitalization from the State Relief Fund in his plea.

The petitioner contends that; section 12 of the Disaster Management Act, 2005 mandates the Ex gratia compensation to the victims of disaster. In the second wave of Covid-19 the people are dying due to the lack of health care facilities. Which is the failure on the part of the Central and State governments. Hence the government is liable to pay the compensation to the families of the persons who lost their lives due to covid-19.

The petitioner pointed out that; one year has been passed, but the National Disaster Management Policy has not been amended yet to include the steps to prevent the spread of Covid-19.

The petitioner contends that; this is inaction of the government is clear violation of the Right to Life and Health granted under Article 21 of the Indian Constitution.

The Pleas is to be heard by Justice Ritu Raj Awasthi and Manish Mathur.
